Final Notice: Submerged Land and the Calculation of the Non-Ad Valorem assessment for the design, acquisition, construction, and installation of the Underground Utility Improvements for the fiscal year October 1, 2017 – September 30, 2018 and future fiscal years

Dear Property Manager or Property Owner:

The Town utilizes the most recent Palm Beach County Property Appraiser parcel data to calculate the Utility Undergrounding assessments which were approved per Initial Assessment Resolution No. 090-2017 and the Utility Undergrounding Assessment Methodology adopted by the Town Council, July 21, 2016.

Certain Tax Parcels or portions of Tax Parcels within the Town are undevelopable due to property specific constraints or legal restrictions. It is fair and reasonable to exclude these Tax Parcels from the Underground Utility Assessment Area because they will receive little, if any, special benefit from the Underground Utility Improvements.

Since the data used to calculate your parcel’s acreage may contain submerged property, you may provide a signed and sealed survey if you wish the Town to consider adjusting the parcel size to remove submerged lands from the assessment calculation.

Time is of the essence. Please note that on December 20, 2017, the Town issued Commercial Paper to finance the Underground Utility Project. Therefore, any request or survey describing a parcel’s total and submerged land received after February 9, 2018 will no longer be considered timely per the Town Code with the request for submerged land assessment adjustment being rejected.

Please govern yourself accordingly. Should you be working on the survey required to adjust your assessment due to submerged land issues as referred hereinabove, please provide a valid survey by February 9, 2018, or you will lose the ability to reduce the assessment for submerged land.
